TX GOP CHAIR, BENKISER EVADING SERVICE?

HOUSTON, TEXAS - The actions of Texas GOP Chairman Tina Benkiser continue to bewilder grassroots activists. Plaintiffs made a concerted effort on Wednesday to insure that documents were prepared as quickly as possible and that a process server was immediately available in order to provide prompt notice to the Republican Party of the court's action. Unfortunateley, Ms. Benkiser appears to be evading service.

According to attorney Gary Polland, "The contact information maintained by the State Bar of Texas for Ms. Benkiser is incorrect. The office is closed the telephone number is no longer in service. Furthermore, efforts to serve Ms. Benkiser at her residence have been unsuccessful."

Late today, plaintiffs learned that a writ of mandamus has been filed in the Court of Appeals, claiming despite repeated telephone conversations, verbal notice of a pending lawsuit, and a written demand letter, that the party had not been contacted. Rather, they claim they became aware of the order through a newspaper article and were "only able to obtain a copy of the TRO from a website created by Plaintiffs."

Debra Medina, Wharton Co. Republican Party Chairman commented, "This type of legal maneuvering by the Party serves only to further alienate the base. Grassroots Republicans are passionate about following the law. It is regrettable that the Party Leadership will not simply agree to alter the order of their agenda to insure that all delegates are properly seated before moving on to convention business. Given the large number of delegates involved in challenges this year, this practice becomes particularly egregious as the ability of these delegates to participate in the process hangs in the balance. We can only hope the Party will change course and follow the law."
